On the Development of Low-carbon Technology and Improvement of Invalidation Request Provisions of Chinese Patent Law——A Reflect on the Case of LiFePO4 Battery

Abstract：The case of LiFePO4 battery was triggered by the China Battery Industry Association which requested invalidation of LiFePO4 patent right of Hydro-Québec,Canada and other patentees,from what we can see that low-carbon technology patents are important to the growth of China s new energy auto industry.Under the background of energy saving and vigorously developing low-carbon technologies in the whole society,this article seeks to improve the provisions which aim at the low-carbon technologies,including adding the ground for invalid request of low-carbon technology patents,accelerating hearing time,simplifying proceedings,and combining with low-carbon public service platform.These suggestions are intended to further test the stability of low-carbon technology patents,making a better contribution to the development of Chinese low-carbon technologies.
