Abstract：“The Overall Scheme of China(Shanghai)Free Trade Zone”pointed out it would achieve effective regulation on intellectual property,industry and commerce,taxation and others areas,and establish the settlement mechanism about the intellectual property dispute mediation,aid and so on.This is a major law abase of strengthening the legal protection of intellectual property rights trade.However,nowadays the system of judicial protection hasn't come into being.Building the perfectly judicial system and the diversified dispute-solving system of intellectual property dispute is urgent,which is the basic guarantee to realize the target of“prior to carry and try”
