中国专利申请资助政策的反补贴风险及防范——基于美国“镜像对等”诉控的视角

摘要中国专利申请资助政策极有可能构成《补贴与反补贴措施协议》意义上的地区专向性补贴。在美国近期将中美经贸关系由“总体互惠”转向“镜像对等”要求的背景下,中国防范专利申请资助政策被采取反补贴措施的方法包括:或将国外创新实体纳入中国专利申请资助的范围;或创设地区专向性所涉“指定地区”的例外;或限缩地区专向性所涉“某些企业”的范围;或证明中国专利申请资助政策并未对美国利益造成“不利影响”。

Abstract：The patent application subsidy policies of China is likely to constitute regional-specific subsidies in the Subsidy and Countervailing Measures Agreement.In the context of the recent shift on economic and trade relations between China and the US from overall reciprocity to mirror reciprocity, measures adopted by China to prevent the countervailing measures include:incorporating foreign innovating entities into the scope of Chinese patent application funding, or creating the exception on the designated area of territorial specificity, or limiting the scope of certain enterprises of territorial specificity, or proving that Chinese patent application funding policies has not adversely affected the interests of the US.
