Abstract：“Right to Data Portability”is still relatively strange for academic community in China.In April 2016,data portability was officially listed in Article 20,the general Data Protection Regulation(GDPR)。It will be fully implemented in all member states of the European Union in May 2018.Data portability is the forefront of human rights development in the world.Its birth means the world's most stringent data protection legislation has begunto be formed.This paper also analyzes its nature and structure in order to cope with the problems of rights positioning caused by abstract information rights in the era of big data.
