The Legal Status of Public Science and Research Institutions and Its Deficiency

Abstract:The legal status of the public science and research institutions is essentially the legalization of the public research system,and also the fundamental condition of good governance on public science and technology system by rule of law.However,due to various reasons,the legal status of China's public science and research institutions has not been formally recognized by the legislative system.It is difficult to reflect the basic and strategic research functions of the public science and research institutions by the legal statues of public body entity,and also difficult to guarantee its nature as a national strategic science and technology organization in lack of specific laws and regulations.Therefore,whether it is from the actual and ideal point of view,China should as soon as possible to achieve the law system on public science and research institutions,in order to resolve their legal status as a national strategic and technological power,to perfect the good governance mechanism between the government and the institutions,and to improve the legal governance framework inside the entities.
