Abstract:In recent years,the rise of the patent operating funds has become an emerging trend in global patent trading market.Driven by national policy leadership and industrial demands,the government agencies in the countries like Japan,South Korea,France and Chinese government have established patent operating funds in cooperation with social capital.From the perspective of the operation objectives,realistic dilemmas,solution paths and the extra-territorial practices of patent funds,the public-private partnership model(PPP model)has strong applicability in the field of patent operations.In practice,the patent-operated funds based on public-private partnership models face a series of challenges at the legal risk and regulatory levels,therefore there's a necessity of further standardizing of the operational procedures;improving the governance mechanisms;preventing and controlling the operational risks;strengthening the performance appraisal and providing a practical and feasible reference path for the benign development of China's patent operating funds.
