企业专利质押决策的影响因素

摘要本文基于企业战略视角,探究企业专利质押决策的影响因素。在专利特征层面,考察专利价值与专利质押的非线性关系;在专利权人特征层面,关注企业规模和企业所有制的影响。基于中国专利调查数据的实证结果表明,专利在市场、技术和法律维度的价值对企业专利质押决策过程具有不同程度的影响;市场和技术维度的价值与专利被质押的概率呈倒U型关系,而法律维度的价值对专利质押没有显著影响;同时,中小企业和私营企业的专利被用于质押的可能性更大。

Abstract：Adopting the strategy perspective,this paper explores the patent-level as well as firm-level factors influencing the firms' decision on patent collateral.The nonlinear relationship between the value of patent and the probability of patent collateral is investigated and the impact of firm size and firm ownership is examined.Using data from surveys of Chinese patents conducted by the National Intellectual Property Administration,the empirical analysis shows that an inverted U-shaped relationship exists between the patent economic and technological value and the possibility of firm patents to be used as collateral.While the legal value of patents doesn't show significant influence.Meanwhile,the patents owned by SMEs and domestic private firms are more likely to be pledged.
