Abstract:For gene editing legislation,first of all,the legal limits of the research and application of this technology should be clarified.At present,about the legal limits of gene editing,there are three local theories including prohibition theory,part-allowed theory and permissible theory,and three legal practice models of extraterritorial countries including the Canadian-style prohibition model,the American-style partial permission model and the British-style examination approval model.The above-mentioned local theoretical views and overseas practice modes can not be adopted as the legal limits of gene editing alone.The reasonable legal limits of gene editing are as follows:allow and guarantee the freedom of basic research in gene editing,strive to avoid Canadian-style criminal penalties and American-style non-subsidy policies.When the technology is mature,germline gene editing for prevention,treatment purposes can be allowed,common gene enhancement as a species can also be accepted,but genetic enhancement of personality should be prohibited.
