Abstract:With the increasing use of wearable devices in daily life, it has greatly improve the quality of user training and recovery, but also bring some privacy risks.At the legislative and judicial levels, the data collected by the device should be classified and protected to a corresponding degree.In other words, the physiological data collected by wearable devices belongs to privacy and personal information.The personally identifiable information belongs to personal information only, and the data around users is neither private nor personal information.When exploring the current regulatory mode for data collected by wearable devices in China, it should be noted that the United States and the European Union have adopted decentralized and unified legislative models relatively, but both of them have certain limitations in reference to China's experience.The underlying reason is that the law needs to strike a balance between the protection of user privacy and the use of such data for scientific research purposes.At the present stage, we should adopt necessary regulations and guidance for the use of data collected by wearable devices.Specifically, it includes clarifying the legitimacy of the protection of personal information rights, determining a personal information collection model with multiple interests in balance, creating exceptions for the use of personal information for scientific research purposes, improving policy regulations of wearable devices and strengthening the self-discipline management of the industry.
