Abstract:Deepfake technology is a combination of deep learning and forgery, which utilizes generative adversarial network algorithms to digitize hyper-real information that never really occurs, and has developed rapidly and widely used in recent years. However, because it is an emerging artificial intelligence technology and there is no special law to regulate it, problems such as infringing the legitimate rights and interests of citizens, threatening social and public security, and undermining the national and even international order are very likely to occur in the application process.By comparing the regulatory practice of deep counterfeiting technology in foreign countries and considering the status quo of legal regulation in China, we should improve the existing regulatory framework for the application of deep counterfeiting technology from several aspects:to solve the problems of the application of existing legal norms and strengthen the protection of personal information, innovate the mode of supervision and strengthen the supervision of deep counterfeiting technology, reasonably allocate the burden of proof, increase the power of tort compensation, and improve the ways of relief.
