Abstract:Currently,standard essential patents(SEPs)have gradually become a key factor in the core competitiveness of the country.Based on IEEE related policy documents,this article sort out and analyzes the background and the evolutionary process of the IEEE standard-essential patent policies,and finds that when IEEE formulates SEP policies,the process is strictly open,attracting public participation,focusing on practical problems,and emphasizing“guarantees”.At the same time,there are also problems such as vague definitions,violations of relevant policies and laws,and unfairness to right holders.When formulating relevant policies,China should also properly handle the relationship between patents and anti-monopoly,and fully consider the rights of each actor in the policy.
