A Comparative Study on the Legislation Design of Local Basic Research System in China——Based on the Implementation of the Science and Technology Progress Law

Abstract：This paper focuses on the system design of local implementation of the Science and Technology Progress Law,starts from the connotation of basic research and the legal environment,and compares and analyzes the differences and respective characteristics of the existing local laws and regulations in the scope of the object of basic research legislation,the legislative design paradigm,the regulation content,etc.,and finds that most of the current local laws and regulations on basic research are few and systematic.The object scope of different local laws and regulations is quite different,including basic research and application basis,and the two have not been clearly defined.The legislative design paradigm and regulatory content of basic research have their own characteristics.Recommendations are as follows.Local governments should write basic research and applied basic research into local regulations as soon as possible,and clarify the connotation and extension of basic research and applied basic research.Local governments may adopt appropriate legislative paradigms in light of their local conditions to define the sources of funding,participants,carriers and main fields of basic research,create a legal environment for the sustainable development of basic research,and promote their own regions to achieve high-level scientific and technological self-reliance.
