Abstract:The new system for mobilizing resources nationwide is an organisational model and operational mechanism for overcoming major scientific and technological projects,and the rule of law in science and technology is an important guarantee for regulating the operation of the new system for mobilizing resources nationwide.China's scientific and technological policy and legal provisions on the new system for mobilizing resources nationwide of macro-guidance is strong,relative lack of operability,which is faced with the situation of system omission and implementation difficulty in the aspects of overall planning and coordination,subject support,organization and management,etc.organizationaland can not effectively respond to the new type of national system of scientific and technological rule of law needs.To promote the transformation of the rule of law in science and technology and the construction of the institutional system for the new system for mobilizing resources nationwide,it is necessary not only to achieve a change in the function of the rule of law from a facilitating law to an incentive law,and to promote the coordinated development of the rule of law at home and the rule of law relating to foreign affairs;it is also necessary to build a framework of the rule of law in science and technology for the operation of the new system for mobilizing resources nationwide,and to establish and improve a sound supporting legal system,so as to provide support for the efficient operation of the new system for mobilizing resources nationwide.
