Abstract：Transforming from software products to web service, software industry in China is suffering from the deficiency of competition culture and insufficiency of innovation stimulation. Compared with safeguarding competition and protecting consumer, fostering innovation should be conceived more in the implementation of competition policy in software industry. MIIT and other competition regulatory sector should reinforce the coordination and cooperation,strengthen the tentative regulating function of AML, and provide sufficient penalties upon the anti-competition action.
