A Study on the Influence of Intellectual Property Clauses in Trans-Pacific Partnership Agreement on China and Countermeasures

Abstract:Trans-Pacific Partnership Agreement (TPP) is being negotiated now.No matter whether China involves in the negotiation of TPP or not, it is bound to create great politics and economic influence on China, because of following reasons:the most favoured nation treatment and national treatment principle and increasing dependence among China and those member countries or potential member countries.The author draws a conclusion:with inherent strong protection intendance, IPR clauses in TPP shall form IPR trade barriers, increase the risk of infringement of IPR in foreign trade, at last it will reduce China's manufacturing exports in a short time;but it can form a reversed transmission mechanism, thus to improve IPR ability in China for a long time.
