Abstract:In response to the severe global climate change, nine countries in the world have launched the fast-tracking green patent regimes. These regimes are mainly divided into three types, which are loose, moderate and strict regimes, varying from the contents to forms, but have the same purpose to fast create green patents through shortening patent prosecution. Based on the evaluation and reflection of the pros and cons of these regimes, the article argues that the regimes are not sufficient for addressing global climate change. The specification of green technologies, the threshold of patentability of public-funded R& D and the construction of relevant green technology database and the classification of green patent are the key conditions for the sustainable development of green patent regime
