Abstract：The increasing attention has been focused on the intellectual property problem during the export of military trade.The problems we faced contain the double IP risk of infringing and infringed.According to the analysis of military trade contracts and patent information,developed countries focus on the patent protection of the manufacturing and testing technology of weapon,but developing countries and areas emphasize the protection of supporting facilities of weapon.The US emphasizes differentiated patent portfolio strategy in different military partners.Russia emphasizes the law of military technical cooperation to avoid IP risk.China barely has patent arrangement in some important partners such as Pakistan,Myanmar and Egypt,facing double IP risk of infringing and infringed.At last,some policy recommendations were purposed
