Abstract：The patents in suits,which were assessed valuable by employers and employees,could be vital evidences in proving which modes is better.Through analyzing the statistics of the maintenance time of patents under different ownership modes,the patents under employer-ownership are more uniform and reasonable in the maintenance time,and the average maintenance time is longer.The maintenance time of patents under employee-ownership varies according to different vacations of employees.In the premise of the principle of agreement priority,policies and legislation should be incline to employer-ownership mode and rewards to employees should be vary in line with vacations
